b. Our services may include but are not limited to advertising campaign planning, creative development, media placement, graphic design, branding strategy, and community management.
3. Intellectual Property
a. You retain ownership of any intellectual property rights related to your brand assets, content, or materials provided to us. By engaging our services, you grant us a limited, non-exclusive license to use these materials solely for the purpose of fulfilling our obligations under these Terms.
b. You agree not to use, reproduce, distribute, or modify any materials provided by us without our express written consent.
4. Placement and Acceptance of Advertisements
a. The placement and acceptance of advertisements on our website or any other platforms are subject to our discretion. We reserve the right to reject or remove any advertisement at any time, without providing a reason.
b. We do not guarantee the availability or placement of any specific advertisement, and we shall not be liable for any damages or losses arising from the rejection or removal of an advertisement.
4. Payment and Refunds
a. Payment for our advertising, graphic design, and community management services shall be made according to the pricing and payment terms specified on our website or as agreed upon in a separate written agreement.
b. Unless otherwise stated, all fees are due and payable in advance. Failure to make timely payment may result in the suspension or termination of services.
c. We accept various payment methods, as indicated on our website. You are responsible for any additional fees or charges imposed by third-party payment processors.
d. Any applicable taxes or duties related to the services provided shall be your sole responsibility and will be added to the total amount due, as required by law.
e. Refunds are provided solely at our discretion. In exceptional circumstances where we fail to deliver agreed-upon services or if there is a material breach of our obligations, we may consider issuing a refund or providing alternative remedies. Refund requests must be made in writing and will be assessed on a case-by-case basis.
f. If you choose to terminate our services, you may be eligible for a refund for the unused portion of the services, excluding any fees and the amount that the campaign has already spent. The amount spent on the campaign includes any expenses incurred on advertising platforms or media placements.
g. Refunds for terminated services will be calculated based on a pro-rata basis, taking into account the remaining duration of the campaign and deducting any non-recoverable expenses or costs incurred on your behalf.
h. In the event of a refund, any work completed or delivered to you prior to the termination request may remain our property, and you may not use or retain any materials, designs, or deliverables associated with the refunded services.
5. Termination
a. We reserve the right to suspend or terminate your access to our services, including advertising, graphic design, and community management, at our sole discretion, without prior notice or liability.
b. Upon termination, your rights to use our services will cease immediately.
6. Modification of Terms
a. We may update or modify these Terms from time to time. Any changes will be effective upon posting the revised Terms on our website.
b. Your continued use of our services after the posting of any changes constitutes your acceptance of the modified Terms.
Compliance with Social Media Regulations and Content Modification
a. When you subscribe to one of our advertising packages, you must comply with the terms and policies of social media platforms such as Facebook, Google, and others. If we determine that your campaign does not meet these terms, we reserve the right to modify the content of your publication to ensure compliance.
7. User Responsibility and Liability
a. If you make a mistake in your advertising campaign, you have the right to pause the campaign once. However, if the mistake is repeated, we will not pause it, and you assume full responsibility for any consequences.
b. If the mistake is from us, we will take immediate action to resolve the problem and rectify any errors on our part.
8. Graphic Design Services
a. We offer graphic design services as part of our advertising and branding solutions. These services may include the creation of logos, visual identities, marketing collateral, and digital graphics.
b. The design process will involve collaboration between you and our design team. You agree to provide clear and timely feedback during the design process to ensure the project progresses smoothly.
c. Upon completion of the graphic design project, you will have the opportunity to review and request reasonable revisions within the scope of the initial project agreement. Additional revisions or major design changes may incur additional fees.
d. You acknowledge that the final design deliverables will be provided in the agreed-upon format and resolution suitable for their intended use.
9. Branding Services
a. Our branding services aim to develop and enhance your brand identity, including brand strategy, positioning, messaging, and visual representation.
b. The branding process will involve collaboration between you and our branding team. You agree to provide accurate and comprehensive information about your brand, target audience, and market positioning to facilitate the branding process.
c. While we strive to provide effective branding solutions, we do not guarantee specific business outcomes or market success resulting from our branding services. The success of your brand ultimately depends on various factors beyond our control.
10. Community Management
a. Our community management services involve managing your online presence, engaging with your audience, and fostering meaningful interactions on social media platforms and other online channels.
b. We will make reasonable efforts to monitor and respond to comments, messages, and inquiries from your audience in a timely and professional manner.
c. You understand that community management does not guarantee the elimination of negative comments or the resolution of all customer concerns. We will work within the boundaries defined by your brand guidelines and applicable laws to address issues and maintain a positive online presence.
d. You are responsible for providing us with accurate and up-to-date information about your products, services, promotions, and any other relevant details to facilitate effective community management.
e. While we strive to uphold high standards in community management, we cannot guarantee the behavior or actions of individuals within your online community.
f. You agree to grant us necessary access to your social media accounts and other online platforms for the purpose of community management. You retain ownership and control over your accounts and may revoke access at any time.
11. Limitation of Liability
a. We strive to provide high-quality graphic design, branding, and community management services. However, we do not guarantee specific results or outcomes from these services. You acknowledge that the success and impact of these services may vary depending on various factors beyond our control.
b. In no event shall we be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with our graphic design, branding, or community management services, including but not limited to loss of profits, data, or business opportunities.
12. Work Days and Weekend Exclusion
a. Our standard work days are Monday to Friday, excluding weekends and public holidays .
b. During our work days, we will make reasonable efforts to respond to your inquiries, provide updates on ongoing campaigns, and address any concerns or issues that may arise.
c. Please note that we have the right to refrain from conducting any campaign-related activities or responding to inquiries during weekends, even if you have paid for our services. Weekend exclusion allows our team members to have designated time off for rest and rejuvenation.
d. In the event that your campaign requires urgent attention or support during weekends, you may contact us by e-mail , and we will assess the situation on a case-by-case basis to determine if any additional charges or expedited services can be provided in only 24 hours
